Bayer CropScience successful in preventing counterfeiting in China

Authorities stop shipment of counterfeit crop protection active ingredient Iodosulfuron

Chinese court confirms IP protection for Bayer’s active ingredient
Monheim, November 14, 2008 – Following a court order, a shipment of Iodosulfuron intended for export to the Middle East from the port of Tianjin in China has been stopped. The counterfeit crop protection substance, for which Bayer CropScience holds an IP right which is also valid in China, was produced illegally by the Chinese companies Dagro Chemical Company Ltd. and Qunye Chemical Company Ltd. The competent court in Tianjin issued an order forbidding the defendants from manufacturing the active ingredient Iodosulfuron illegally and marketing it. Both companies must destroy any inventories immediately and pay compensation to Bayer CropScience.

“The illegal manufacture of and trade in products not only violate our patent rights. Illegally produced crop protection products are untested, unregulated and are thus a danger to the health of farmers and consumers and to the environment,” said Dr. Ralf-Rüdiger Jesse, Head of Patents and Licensing at Bayer CropScience.

There is a rapid growth of counterfeit and illegally-traded crop protection products in Europe and worldwide. Most of the counterfeit products now come from China. “The rapid expansion of chemical manufacturing capabilities in that country has made this possible,” Dr. Jesse said. He pointed out that robust patent protection is the basis of Bayer CropScience’s innovative strength. The company is therefore determined to defend its intellectual property rights – which include patents, trademarks and copyrights – against illegal manufacturers in China and elsewhere with all the legal remedies available to it.

Iodosulfuron is an herbicidal active ingredient marketed by Bayer CropScience under the brand name Hussar®. Launched in 1999, Hussar® is a leading foliar cereal herbicide. It is registered in major cereal-growing countries in Europe, the Middle East, Africa, South America, and in Australia, Russia and Ukraine. It can be used on wheat, rye, triticale and spring barley to control a broad spectrum of weeds, including loose silky bent, rye grass, wild oats and broad-leaved weeds.
